1. Introduction
The terms and conditions set out herein apply to each agreement entered into between you and us for the provision of our Staff to a Service to you or Event. Dynamique Dance & Parties ("us", "we", “the company”, “staff”, “teachers”, “dancers”) provides its service to you ("the client", "the couple", "the party organiser”, "you", “others”), subject to the following terms and conditions, which may be updated without prior notice.
2. Provision of Services and Status
We agree: -
2.1 To provide the services as specified in writing in a professional, friendly and timely manner. Staff shall be suitably qualified and experienced for the agreed purposes.
2.2 To provide up to date DBS checked teachers to work with children and the vulnerable where appropriate and when applicable.
2.3 To not disclose personal information to any third party unless agreed in writing by you.
2.4 To request written permission to use any images, names and videos that features yourself or others on our website and in our marketing and promotion.
2.5 To provide all music for lessons, classes and parties unless otherwise agreed.
3. Your Obligations to us:
You agree: -
3.1 To be responsible for the health and safety of our staff when in your care. You/the venue will maintain adequate insurance cover to underwrite your obligations to our staff if applicable.
3.2 Provide a suitably sized space within your home/venue by clearing obstacles away that could be deemed as dangerous or a trip hazard. Dynamique Dance & Parties does not accept liability for any injuries.
3.3 Provide a telephone number we can contact you on, on the day of the booking.
3.4 To notify our staff and company of any health issues or prior injuries before physical activity commences.
3.5 To provide suitable breaks for our staff that comply with employment law as required during long bookings. (To be confirmed with the client upon booking).
3.6 To be available at the time of service. See our cancellation policy also.
3.7 To honour the entire booking duration.
3.8 The Clients confirm that they have, or do not need, permission or a license to use
and/or play music
3.9 Pay by the deadline or incur late fee charges
4. Booking
(4.1) Confirmation of order will be accepted verbally or in writing and will be confirmed in writing by Dynamique Dance & Parties with full details of the service and costs we have agreed.
(4.2) After a booking has been made clients are obliged to continue that booking with Dynamique Dance & Parties and not to liaise directly with our teachers, dancers or any other staff representing Dynamique Dance & Parties. This is a breach of contract and would result in that staff member being permanently removed from our company and a fee imposed on the client. Dynamique Dance & Parties have chosen their small pool of staff carefully based on their experience, training, qualifications, locality and good character and would therefore not expect such dealings to ensue. Dynamique Dance & Parties will use their small pool of staff only when the sole trader Katie Keating (nee Davidson) is unable to honour the booking herself.
5. Fees & Payment
(5.1) All fees are to be negotiated by Dynamique Dance and are subject to change and may vary from advertised due to distance, costumes, props and other costings. All fees will be negotiated before a booking is confirmed.
(5.2) All fees must be paid by a direct BACS transfer. We currently do not accept cheques, PayPal or credit cards. We request that a deposit be paid within 14 days of the confirmed booking. Bookings will not be confirmed until the deposit has been paid and cleared. Where a client decides to pay a deposit instead of full payment, the balance payment is required 7 days prior to the service date or on the service date in cash to staff. Late payments after 48hrs of the agreed date will incur late fees charged at £1 per day. Failure to pay these fees will result in the booking being cancelled and no reimbursement will be made of any fees paid. This is to ensure clients pay on time so we can accommodate the costs for equipment/costumes/rehearsals space etc our end.
(5.3) Long-term contracts will be invoiced on a regular basis with monies to be paid to Dynamique Dances within 28days of the service date. In some circumstances, we reserve the right to request payment before services commence.
6. Cancellations
(6.1) Our Cancellation Policy is that full payment be made by the client if Dynamique Dance & Parties is not notified of cancellation within 48 hours of the agreed service date. Where deposits have been paid these will not be refunded. For clients who wish to move the date of service this will not usually incur a fee unless costs are involved to move the service date, these costs would be discussed and negotiated with the client.
(6.2) Dynamique Dance & Parties in extreme circumstances reserves the right to cancel a lesson within 24 hours notice. Cancellation should only occur in the event of a teacher/dancer becoming unavailable for a booked service due to circumstances out of our control (for example: illness, family emergency, bereavement). Dynamique Dance & Parties will take reasonable steps to either reschedule the booking or find a replacement.
7. Conduct
(7.1) Dynamique Dance & Parties cannot be held responsible for the lateness of staff. In the unlikely event that this may occur the teacher/dancer would add on that late time to the end of the service. We value ourselves on being fair and courteous and would endeavour to notify the client of any lateness beforehand.(7.2) In the unlikely event of a no-show, a suitable member of staff would be posted immediately to the booking, where this could not occur a refund would be negotiated or an alternative service date agreed and another staff member deployed at a later date.
(7.2) Dynamique Dance & Parties cannot accept any liability or responsibility for injuries as a result of our services. Clients participate at their own risk and are adequately warmed up and cooled down and made aware of any risks throughout the class/service by our trained and experienced staff. It is the individual’s responsibility to stop activity if they feel pain or shortness of breath and to notify a staff member immediately.
8. Indemnity
(8.1) You agree that Dynamique Dance & Parties and it’s staff, will not be liable to you for any claim or demand, including reasonable solicitors' fees, due to or arising from your service with Dynamique Dance.
9. Entire Agreement and Applicable Law
(9.1) This Agreement sets out all of the terms between the Company and the Clients.
This contract shall be governed in accordance with the laws of England and English Courts shall have jurisdiction in relation to the Agreement.
10. Specific terms & conditions
(10.1) Wedding dance tuition & choreography
(10.1i) Dynamique Dance will provide a teacher/dancer to assess the couple’s personalities and requirements and music choice and will deploy both a short warm up and cool down, teach varied steps and movements, choreograph the movements into a routine suitable for the couple with their say so and rehearse the finished dance with the couple to ensure that they are confident, happy and that the dance is to a performance standard.
(10.1ii) In the unlikely event that a couple are unhappy with the dance the couple must communicate this immediately to the teacher/dancer so that steps can be taken to involve the couple’s ideas.
(10.1iii) Where a course of lessons have been booked and paid for the client must honour that booking for the entire duration.
(10.1iv) The Clients confirm that they have, or do not need, permission to use the music for the First Dance.
(10.2) Dance Parties
(10.2i) Dynamique Dance & Parties is not responsible for finding the venue unless agreed in writing and paid for beforehand.
(10.2ii) It is the venue and client’s responsibility to ensure that the venue is suitably sized, safe, has access to parking and is licensed to play music and if applicable allow the consumption of alcohol
(10.2iii) The party will as a minimum consist of a warm up, games for children, the tutoring, choreography and rehearsal of a dance routine, its performance and a cool down and stretch.
(10.2iv) Parties cannot be cancelled part way through a party.
(10.2v) The party organiser is responsible for the behaviour and conduct of children and adults at the party. It is not the staff’s responsibility to discipline unruly children/adults. Dynamique Dance & Parties staff have the right to refuse participation if they feel that any persons are ruining the party for others or are acting in a dangerous manner.
(10.2 vi) Any theft of or damage to equipment, property, costumes and props will incur a charge.
(10.3) Show Choreography
(10.3i) Dances and shows choreographed by Dynamique Dance & Parties remain the property of Dynamique Dance & Parties and credit should be mentioned in any future marketing material and video footage.
